While criminal offenses in Wisconsin are ultimately categorized into different types based on the nature of the crime itself, most crimes will be classified as either a misdemeanor or felony. The main differentiating factor between these two different types of crimes lies in the length of potential incarceration that can result from a conviction, as well as where this time is to be spent.
Misdemeanors are crimes that are punishable by no more than 9 months in county jail, along with other penalties such as fines and probation. These offenses are divided into three different “classes” depending on their severity. Class A misdemeanors are the most serious of the bunch, with Class B and Class C carrying lesser punishments respectively.
Felony charges are much more serious. These offenses are punishable by a jail term of one year or longer, with the possibility of life imprisonment for the most serious crimes. As opposed to misdemeanors where jail sentences are served in local state or county jails, incarceration for felony offenses is served in the Wisconsin State Prison System. Similarly to misdemeanors, felonies are divided into different classes, with Class A carrying the harshest penalties. Additionally, a felony conviction will result in the forfeiture of civil liberties such as the right to vote, second amendment rights, and the ability to hold public office.
