What Are the Penalties for Multiple OWI/DUI Convictions?

In the state of Wisconsin, first offense DUI and OWI cases are handled in civil court. A repeat offense, however, is considered a criminal offense and will be prosecuted as such.

If convicted, a person accused of a multiple OWI can face:

  • For a second offense, up to six months in jail and fines up to $1,100
  • For a third offense, up to one year in jail and fines up to $2,000
  • For a fourth offense, up to six years in jail and fines up to $10,000

Driver’s license suspension is also a strong possibility, varying in length depending on the number of priors that a person has on their record. Penalties are also greater for individuals who have been issued commercial driver’s licenses and those who have refused to take chemical tests.
